Y was charged with allegations of sexual assault, unlawfully choking with intent to commit an indictable offence and assault, contrary to sections 271, 246, and 266 of the Criminal Code of Canada. The allegations arose following a drunken one night stand where the complainant went to the police many months later after Y would not continue to see her. Y retained Curtis Mennie to review his case and fight for him at trial. Calgary Defence lawyer Curtis Mennie reviewed disclosure, including preliminary inquiry transcripts, and came to realize that the credibility of the complainant was going to be a major issue for the Crown in proving their case. After having discussions with the Crown it was agreed that all charges against Y would be withdrawn and Y would agree not to have any contact with the complainant for 1 year by way of a peace bond. Thanks to Curtis Mennie Y was saved from having to testify at trial and all charges against Y were dropped and Y received no criminal convictions.
