REGINA V B.J. [PROVINCIAL COURT, DRUMHELLER]
B was charged with the serious offence of sexual assault of his common law partner contrary to section 271 of the Criminal Code. The allegations arose in the course of a child custody dispute where each party was arguing over who should get more time with the child. After retaining Calgary Defence lawyer Curtis Mennie, disclosure was reviewed and it was determined that the Crown would have serious issues with the credibility of the complainant due to serious multiple inconsistent statements that were given. After reaching out to the Crown’s office it was agreed that the charges would be withdrawn and B would not contact the complainant for 1 year except through legal counsel. Thanks to Curtis Mennie, B was saved from having to testify in Court and all charges against B were withdrawn and B received no criminal convictions.
