Drug Offences
Drug offences can range from the possession of a controlled substance to the possession for the purpose of trafficking to the production of a controlled substance. Drug offences are highly technical and almost always involve the Charter as there has to be a search and seizure done to acquire any controlled substance. Finding Charter violations can lead to certain evidence being excluded. Hiring a lawyer who can spot and argue Charter violations in addition to all other defences that may be available is critical for a successful defence.
Some drug offences can be dealt with by an Alternative Measures Program while others, depending on the circumstances of the alleged offence, may carry a mandatory minimum sentence. It's important to contact an experienced lawyer to review your disclosure and fight for your rights.
