REGINA V A.A. [PROVINCIAL COURT, AIRDRIE]

A was charged with the serious offence of sexual assault contrary to section 271 of the Criminal Code. The allegations arose when a previous girlfriend attended a church meeting about celibacy, where the pastor informed the attendees that those who had pre-marital sex would not get into heaven. At that point the ex-gf claimed that 2 years previously in the living room basement of A’s home, she was sexually assaulted while A’s parents were home and then they drove her home. A retained Calgary defence lawyer Curtis Mennie who entered pleas of not guilty and scheduled the matters for trial. Curtis Mennie worked closely with A and their family to prepare for the issues at trial. One week prior to trial the Crown reached out to Curtis Mennie to discuss the case and the problems with proceeding. Following that conversation it was agreed that the Crown would withdraw the charge and A would agree not to contact A and keep the peace for 1 year. A received no criminal conviction.
