REGINA V P.S. [PROVINCIAL COURT OF ALBERTA, COCHRANE]
P was charge with serious allegations of a major sexual assault contrary to section 271 of the Criminal Code. The allegations arose following a complaint made to the Cochrane RCMP that P forcefully, and without consent, engaged in intercourse with the complainant. After retaining the law office of Calgary criminal lawyer Curtis Mennie the matter was expeditiously scheduled for trial and pleas of not guilty were entered. After reviewing the disclosure, Calgary defence lawyer Curtis Mennie came to realize that the credibility and reliability of the complainant was very thin. Following 4 pretrial conferences with the assigned Crown a number of evidentiary issues arose that put the Crown at a significant disadvantage. Following the last pretrial conference, where Calgary defence lawyer Curtis Mennie successfully opposed the Crown’s application to adjourn the trial date, the charges against P were stayed. P received no criminal record.
