M was charged with allegations of breaching a condition of his recognizance not to be within a certain distance of the complainant’s home contrary to section 145 of the Criminal Code. Calgary Criminal lawyer Curtis Mennie met with M and prepared a defence which included an alibi witness. M’s own son was able to give a statement to the RCMP about the location of M at the time of the offence. Prior to trial the Crown’s office was seeking a jail sentence on a plea of guilty. On the day of trial, Calgary criminal lawyer Curtis Mennie entered Court prepared to run the case. On the day of trial the charge was withdrawn by the Crown prosecutor. M received no criminal record.
