REGINA v T.J. [PROVINCIAL COURT, LETHBRIDGE]
T was charged with allegations of impaired operation of a conveyance and over 80 operation of a conveyance, contrary to sections 320.14(1)(A) and 320.14(1)(B) of the Criminal Code. The charges were brought against T after the Lethbridge police pulled him over late at night when T was driving with his lights off. T retained Curtis Mennie who reviewed the disclosure and immediately observed that there was no impaired case at all and the police made an error with respect to following the law for demanding roadside samples of breath. Charter notice was filed to argue these issues. On the day of trial Curtis Mennie arrived prepared to argue the case and the Crown withdraw all charges against T. T received no criminal convictions.
