REGINA V B.T. [PROVINCIAL COURT, PANOKA]
B was charged with allegations of impaired operation of a conveyance and operating a conveyance with an alcohol concentration over 80 contrary to 320.14(1)(A) and 320.14(1)(B) of the Criminal Code. B was arrested following a high speed single vehicle collision on a snowy night on the highway. After retaining Calgary defence lawyer Curtis Mennie, pleas of not guilty were entered and the matters were scheduled for trial. Curtis Mennie filed charter notice with respect to the RCMP not following the law during the seizure of breath samples. The Crown withdrew the over 80 charge prior to trial and on the day of trial withdraw the impaired charge. B received no criminal record and all charges against him were withdrawn.
