H was charged with a single count of sexual interference contrary to section 151 of the Criminal Code. The allegations arose following an interview given by the complainant to the RCMP and the allegations consisted of inappropriate groping. H retained Defence lawyer Curtis Mennie who immediately sought the interview during which the “accusations” were made. Following disclosure it became very apparent that the witness had attempted to recant several times and was threatened by the police for doing so. The witness was suffering from serious mental health issues all of which were brought to the attention of the Crown, including the witness recanting to several family members and to her doctor. Once the materials were reviewed by the Crown the charges against H were withdrawn. He received no criminal record.
