REGINA V N.S. [PROVINCIAL COURT OF ALBERTA, CALGARY]

N was charged with a municipal bylaw offence under section 25 of the Responsible Pet Ownership, for allegations that her two family dogs were threatening individuals in her backyard. The public had an easement on her property and N had video surveillance showing the behavior of her dogs. Defence set the matter down for trial to run on the issues of due diligence and that the offence was not proven beyond a reasonable doubt. Following trial where the complainant, the municipal bylaw officer, and N testified, the Worship concluded that the allegations were not made out beyond a reasonable doubt and N was found not guilty.
