R was charged under section 254 and 253(1)(a) of the Criminal Code for refusal to provide a breath sample and impaired operation of a motor vehicle. Following the trial, Calgary defence lawyer Curtis Mennie provided the Crown with case law outlining their burden to prove beyond a reasonable doubt that there were reasonable and probable grounds for the arrest of R including R being in care or control of the motor vehicle.
