REGINA V C.J. [PROVINCIAL COURT OF ALBERTA, CALGARY]
J was charged under the Traffic Safety Act for failure to remain at the scene of an accident and careless driving. The allegations arose out of an accident report J was compelled to make under the Traffic Safety Act which was in violation of J's section 7 right against self-incrimination. Defence lawyer Curtis Mennie filed a charter application asking to exclude all of the Crown’s evidence of identification. Following a meeting with the Crown about the case, all tickets were withdrawn as any evidence used to convict J would be inadmissible in Court.
